These SmartTV Club App Terms of Use and End User License Agreement (“Terms” or “Agreement”) govern your access to and use of the SmartTV Club applications for mobile devices, smart TVs, connected TV devices, websites, account features, license management tools, subscriptions, digital services, and related functionality collectively referred to as the “App” or “Service”.
Please read these Terms carefully before using the App.
By downloading, installing, accessing, registering for, purchasing, subscribing to, activating, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not download, install, access, purchase, subscribe to, activate, or use the App.
These SmartTV Club App Terms of Use and End User License Agreement (“Terms” or “Agreement”) govern your access to and use of the SmartTV Club applications for mobile devices, smart TVs, connected TV devices, websites, account features, license management tools, subscriptions, digital services, and related functionality collectively referred to as the “App” or “Service”.
Please read these Terms carefully before using the App.
By downloading, installing, accessing, registering for, purchasing, subscribing to, activating, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not download, install, access, purchase, subscribe to, activate, or use the App.

In these Terms, “SmartTV Club”, “Company”, “we”, “us”, or “our” refers to SIA ANIGAN. - Important Notice: SmartTV Club Is a Software Player Only
2.1. Software player only. SmartTV Club is a software media player only. SmartTV Club does not provide, sell, host, broadcast, retransmit, curate, recommend, promote, or distribute any television channels, movies, playlists, EPG data, streams, audiovisual content, or other media content.
2.2. User-provided content sources only. The App allows users to play or manage content sources that they already have lawful access to. Such sources may include, for example:- M3U URLs;
- EPG URLs;
- playlist files stored locally by the user;
- media sources added by the user;
- content sources obtained from third-party providers.
2.3. User responsibility. You are solely responsible for ensuring that you have the legal right to access, add, import, stream, view, or otherwise use any playlist, URL, EPG source, file, stream, or content accessed through the App.
2.4. No verification by SmartTV Club. SmartTV Club does not verify, control, monitor, guarantee, or take responsibility for the legality, ownership, licensing status, availability, accuracy, quality, safety, or continuity of any user-added or third-party content source.
2.5. No affiliation with IPTV providers. SmartTV Club is not affiliated with, endorsed by, sponsored by, or responsible for any IPTV provider, broadcaster, playlist provider, content owner, streaming provider, or third-party content source used by any user.
2.6. No content support. SmartTV Club support is limited to the technical functionality of the App, account access, license access, payment status, and compatibility of the Service. We do not provide support for the availability, legality, quality, stability, or content of third-party playlists, IPTV services, channels, streams, or EPG sources.
2.7. No preloaded, recommended, or promoted content. The App does not contain any preloaded channels, movies, playlists, IPTV subscriptions, or audiovisual content. SmartTV Club does not recommend, advertise, sell, resell, or promote any IPTV provider, playlist provider, broadcaster, channel package, or third-party content source. Users must independently obtain and add only lawful content sources to which they have legitimate access.
2.8. No facilitation of unauthorized content. The App is not intended to facilitate access to pirated, unauthorized, infringing, sanctioned, prohibited, or otherwise unlawful content. Any use of the App with such content sources is strictly prohibited and is the sole responsibility of the user. - Acceptance of Terms
3.1. Binding agreement. These Terms form a legally binding agreement between you and SIA ANIGAN.
3.2. Use of the App. By using the App, you confirm that you are legally able to enter into this Agreement and that your use of the App complies with applicable laws.
3.3. Privacy Policy. Our Privacy Policy forms an integral part of these Terms. If the App, our website, or related services use cookies, tracking technologies, analytics tools, or similar technologies, additional notices may apply.
3.4. Mandatory law. Nothing in these Terms limits any rights you may have under mandatory consumer protection, privacy, or other applicable laws. - Changes to These Terms
4.1. Updates. We may update these Terms from time to time.
4.2. Notice. Where changes are material or where required by law, we will take reasonable steps to notify users, for example by email, in-app notice, website notice, platform notification, or notice through the relevant app store or smart TV platform where applicable.
4.3. Effective date. The updated version takes effect when published in the App, on our website, or otherwise made available with a new “Last Updated” date, unless a later effective date is stated.
4.4. Continued use. Your continued use of the App after the updated Terms become effective constitutes acceptance of the updated Terms.
4.5. If you disagree. If you do not agree to the updated Terms, you must stop using the App and, where applicable, cancel your subscription before the changes take effect. - Eligibility and Age Requirements
5.1. Minimum age. You must be at least 18 years old to purchase a SmartTV Club subscription, license, or paid service.
5.2. Use by minors. Minors may use the App only under the supervision and responsibility of a parent or legal guardian.
5.3. Responsibility of adult user. If you allow a minor to use the App through your account, device, subscription, or license, you are responsible for ensuring that such use complies with these Terms and applicable laws. - Account Registration and Security
6.1. Account creation. Certain App functions may require account registration.
6.2. Accurate information. You agree to provide accurate, current, and complete information when creating or updating your account.
6.3. Valid email address. You must provide a valid and accurate email address that you own or are authorized to use.
6.4. Account credentials. You are responsible for keeping your login credentials confidential and secure.
6.5. Account activity. You are responsible for all activity that occurs under your account, unless caused by our breach of these Terms or applicable law.
6.6. Unauthorized access. You must notify us immediately if you suspect unauthorized access to your account, device, subscription, license, or payment method.
6.7. Account protection. We may suspend, restrict, or delete accounts that violate these Terms, applicable law, platform rules, or that pose security, legal, operational, reputational, payment, or user safety risks. - License to Use the App
7.1. Limited license. Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, access, and use the App for lawful personal and non-commercial use.
7.2. Platform-specific use. Your use of the App may also be subject to the usage rules of the platform from which you downloaded, installed, purchased, activated, or accessed the App, including Apple App Store, Google Play, LG Content Store, Samsung Smart TV platforms, or other authorized distribution platforms.
7.3. No sale. The App is licensed, not sold, to you.
7.4. Restrictions. You may not copy, modify, sell, resell, rent, lease, sublicense, distribute, reverse engineer, decompile, disassemble, circumvent security features, or otherwise exploit the App except as expressly permitted by these Terms or mandatory law.
7.5. Rights reserved. All rights not expressly granted to you are reserved by the Company and its licensors. - Acceptable Use and Prohibited Conduct
8.1. General rule. You may use the App only for lawful purposes and in accordance with these Terms.
8.2. Prohibited use. You may not use the App to access, add, import, view, stream, manage, distribute, or otherwise use content sources that:- are illegal, pirated, unauthorized, infringing, sanctioned, or prohibited;
- infringe copyright, trademarks, image rights, privacy rights, publicity rights, broadcasting rights, or other third-party rights;
- contain or promote terrorism, extremism, illegal drugs, weapons, criminal activity, or unlawful conduct;
- contain pornography, sexual exploitation, abuse, violence, hate, discrimination, harassment, threats, or defamation;
- violate applicable law, sanctions, media restrictions, platform policies, or these Terms.
8.3. Prohibited technical conduct. You may not:- circumvent, disable, damage, or interfere with App security, license checks, payment checks, or access controls;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except where expressly permitted by law;
- overload, disrupt, scrape, crawl, mine, automate, or interfere with the App, its APIs, servers, or infrastructure;
- use the App to distribute malware, spam, phishing, fraud, scams, or deceptive content;
- use the App in a way that harms other users, the Company, platform providers, payment providers, or third parties.
8.4. Enforcement. We may restrict features, suspend accounts, disable licenses, or terminate access where reasonably necessary to protect users, comply with law, comply with platform requirements, enforce these Terms, prevent fraud or abuse, or maintain service integrity. - User-Added Content Sources
9.1. User-added sources. Any playlist, EPG URL, M3U URL, file, stream, media source, or other content source used with the App is added, selected, obtained, and controlled solely by the user or a third-party provider, not by SmartTV Club. The App does not include preloaded playlists, channels, movies, or audiovisual content.
9.2. Lawful access required. You must not use the App to access, view, stream, reproduce, distribute, or otherwise use any content unless you have the lawful right to do so.
9.3. No illegal content use. You must not use the App with content sources that are illegal, pirated, unauthorized, infringing, sanctioned, prohibited, or otherwise unlawful in your jurisdiction or in Latvia.
9.4. No circumvention. You must not use the App to circumvent geo-blocking, sanctions, copyright restrictions, access controls, broadcaster restrictions, technical protection measures, or any other legal or technical limitations.
9.5. No responsibility for third-party providers. SmartTV Club is not responsible for any third-party IPTV provider, playlist seller, broadcaster, stream source, content owner, or service provider, including their legality, reliability, pricing, support, availability, or conduct.
9.6. No duty to restore content. SmartTV Club has no obligation to restore, replace, repair, locate, recommend, or provide alternative access to any user-added or third-party content source that stops working, becomes unavailable, is removed, is blocked, is restricted, or becomes unlawful. - Prohibited Channels, Sanctioned Media, and Restricted Content
10.1. Compliance position. SmartTV Club is aligned with applicable EU, Latvian, and international legal restrictions, sanctions, media regulations, platform policies, and decisions of competent authorities concerning prohibited or sanctioned media sources.
10.2. Prohibited channels and sources. Certain channels, media outlets, broadcasters, streams, playlists, or content sources may be prohibited from being accessed, added, viewed, or used through the App, regardless of the user’s location, the origin of the content, or the method by which the user obtained access.

10.3. User obligation. You must not add, access, view, stream, or otherwise use prohibited channels or restricted media sources through the App.
10.4. Breach of Terms. Any attempt to access or use prohibited channels or restricted media sources through the App may be considered a material breach of these Terms.
10.5. Enforcement. If we become aware of such use, we may take necessary action, including but not limited to restricting functionality, suspending access, terminating an account, disabling a license, blocking certain technical sources, or cooperating with competent authorities where legally required.
10.6. Prohibited list. The current list of prohibited channels and restricted media sources may be provided in an Annex to these Terms or in a separate Prohibited Channels and Restricted Media Sources Policy made available through the SmartTV Club website or App. The list may be updated from time to time to reflect applicable laws, sanctions, regulatory decisions, court orders, platform policies, and decisions of competent authorities.
10.7. Reference to official restrictions. Without limiting the general nature of this section, prohibited or restricted sources include media outlets and television programmes subject to EU restrictive measures or excluded or restricted by the National Electronic Mass Media Council of Latvia or other competent authorities.
10.8. Reporting and action on prohibited sources. Users, rights holders, regulators, platforms, or other affected parties may report suspected illegal, infringing, prohibited, sanctioned, or abusive content sources by contacting [email protected]. Where technically feasible and legally appropriate, SmartTV Club may investigate reports and may restrict, block, remove, or disable access to specific sources, accounts, devices, or features in order to comply with applicable law, platform requirements, rights-holder notices, or competent authority decisions.
10.9. Technical limitations. Because SmartTV Club does not provide, host, broadcast, retransmit, curate, recommend, promote, or control user-added or third-party content sources, our ability to review, monitor, or block specific content may be technically limited. However, we may take reasonable measures available to us to enforce these Terms and comply with applicable law and platform requirements. - Subscriptions, Licenses, Billing, and Digital Purchases
11.1. Paid features. The App may offer paid features, including subscriptions, licenses, premium functionality, device activation, or other digital services.
11.2. Software license only. A subscription, license, or paid service gives you the right to use the SmartTV Club software and related technical functionality. It does not include, grant, sell, provide, or guarantee access to any channels, movies, playlists, IPTV subscriptions, streams, audiovisual content, or third-party content services.
11.3. Platform purchases. Purchases may be processed through Apple App Store, Google Play, SmartTV Club’s website, smart TV platforms, or another authorized payment provider. Such purchases are subject to the applicable platform’s or payment provider’s terms, billing rules, tax rules, currency rules, cancellation rules, and refund policies.
11.4. Subscriptions. Subscriptions may automatically renew unless cancelled before the end of the current billing period through the same platform, payment method, or account system through which the subscription was purchased or activated.
11.5. Uninstalling the App. Uninstalling the App does not automatically cancel your subscription. You must cancel the subscription through the same platform, payment method, or account system through which it was purchased or activated.
11.6. Free trials and introductory offers. If a free trial or introductory offer is provided, the duration, price, renewal terms, and cancellation conditions will be disclosed before purchase or enrollment. Unless cancelled before the trial ends, the subscription may automatically convert into a paid recurring subscription.
11.7. Trial purpose. Any free trial or free access period is intended to allow users to test the basic functionality, compatibility, and usability of the App on their device before purchasing a paid subscription or license.
11.8. Price changes. Prices, features, subscriptions, licenses, and paid plans may change prospectively. Such changes do not affect completed purchases unless required by law or platform rules.
11.9. Taxes and currency. Prices may include or exclude VAT, sales tax, or other taxes depending on applicable law and platform rules. Currency conversion may be handled by the platform or payment provider.
11.10. Platform-specific purchase flows. Where required by the rules of the platform through which the App is distributed, digital purchases, subscriptions, renewals, cancellations, and refunds must be completed through that platform’s approved purchase flow. Nothing in these Terms is intended to permit a purchase, payment, cancellation, or refund method that is not allowed by the applicable platform rules.
11.11. Restore purchases. Where purchases are made through Apple App Store, Google Play, a smart TV platform, or another platform that supports purchase restoration, users may restore eligible purchases through the App or the relevant platform account, subject to the platform’s rules and technical availability. - Cancellation and Refunds
12.1. Platform and payment provider rules apply. Refunds, cancellations, billing issues, and subscription management for purchases made through Apple App Store, Google Play, SmartTV Club’s website, a smart TV platform, or another third-party payment provider are handled according to the rules of the same platform, payment method, or account system through which the purchase or subscription was made, together with any mandatory consumer protection laws.
12.2. Cancellation. You may cancel a subscription at any time through the same platform, payment method, or account system through which the subscription was purchased or activated. For example, if you subscribed through Apple App Store, cancellation must be completed through your Apple ID subscription settings; if you subscribed through Google Play, cancellation must be completed through your Google Play subscription settings; if you subscribed through a smart TV platform, cancellation must be completed through the relevant smart TV platform account, billing, or subscription management system where available; and if you subscribed directly through SmartTV Club or another authorized payment provider, cancellation must be completed through the relevant account, billing, or cancellation method made available for that purchase.
12.3. Uninstalling the App. Uninstalling the App does not cancel your subscription. You must cancel the subscription through the same platform, payment method, or account system through which it was purchased or activated.
12.4. Access after cancellation. Unless stated otherwise by the relevant platform, payment provider, or applicable law, after cancellation you may continue to access paid subscription features until the end of the current paid billing period.
12.5. No partial refunds by default. Except where required by applicable law, platform rules, or payment provider rules, we do not provide refunds or credits for partial billing periods, unused subscription time, unused features, device incompatibility discovered after purchase, or issues caused by third-party playlists, IPTV providers, channels, streams, EPG sources, or content services.
12.6. Content-related issues are not grounds for refund. Because SmartTV Club does not provide, control, host, broadcast, or guarantee any content, refunds will not be issued solely because a third-party playlist, IPTV provider, channel, stream, EPG source, or content service is unavailable, unstable, illegal, blocked, removed, restricted, changed, or no longer accessible, except where required by applicable law, platform rules, or payment provider rules.
12.7. Refund consequences. If a refund is issued for a purchase, we may revoke access to the associated subscription, license, digital service, or paid feature to the extent permitted by law, platform rules, and payment provider rules.
12.8. Suspension for violations. If your account is suspended or terminated due to violation of these Terms, fraud, abuse, illegal activity, prohibited content, or payment misconduct, you may lose access to subscriptions, licenses, or paid features, except where mandatory law, platform rules, or payment provider rules provide otherwise. - Apple App Store Terms
This section applies if you download, access, purchase, subscribe to, or use the App through Apple App Store.
13.1. Agreement with Company, not Apple. You acknowledge and agree that these Terms are concluded between you and SIA ANIGAN only, and not with Apple. SIA ANIGAN, not Apple, is solely responsible for the App and its content.
13.2. Scope of license. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded product that you own or control and as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume purchasing rules.
13.3. Maintenance and support. SIA ANIGAN is solely responsible for providing maintenance and support for the App as specified in these Terms or as required by applicable law. Apple has no obligation to provide maintenance or support services for the App.
13.4. Warranty. To the extent any warranty exists under applicable law and has not been effectively disclaimed, SIA ANIGAN is solely responsible for such warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
13.5. Product claims. SIA ANIGAN, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including product liability claims, regulatory claims, consumer protection claims, and claims that the App fails to conform to applicable legal or regulatory requirements.
13.6. Intellectual property claims. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, SIA ANIGAN, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim.
13.7. Legal compliance. You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
13.8. Third-party terms. You must comply with applicable third-party terms when using the App.
13.9. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary. - Google Play Terms
This section applies if you download, access, purchase, subscribe to, or use the App through Google Play.
14.1. Google Play terms. Your use of the App may also be subject to Google Play’s applicable terms, policies, billing rules, subscription rules, and refund policies.
14.2. Billing through Google Play. Purchases, subscriptions, cancellations, billing issues, taxes, and refunds made through Google Play may be handled by Google Play and are subject to Google Play’s rules and mandatory consumer protection laws.
14.3. Subscription cancellation. If you purchased a subscription through Google Play, you must cancel it through your Google Play account settings or another cancellation method made available by Google Play.
14.4. Uninstalling the App. Uninstalling the App does not cancel a Google Play subscription.
14.5. Access after cancellation. If you cancel a Google Play subscription, access may continue until the end of the current paid billing period, unless Google Play’s rules or applicable law provide otherwise.
14.6. Failed payment. If your payment method is declined or a subscription cannot be renewed, Google Play may cancel, pause, suspend, or otherwise manage the subscription according to its own rules.
14.7. Developer support. For App functionality and account support, you may contact SIA ANIGAN at [email protected]. For Google Play billing or refund matters, you may also need to contact Google Play. - Direct Purchases Through SmartTV Club or Other Authorized Payment Providers
This section applies only where direct purchases outside Apple App Store, Google Play, or a smart TV platform are made available in a manner permitted by applicable law and the rules of the platform through which the App is distributed.
15.1. Direct billing. If you purchase directly through SmartTV Club or an authorized payment provider, your purchase, billing, renewal, cancellation, and refund process may be managed through the relevant account, billing portal, or payment provider used at the time of purchase.
15.2. Direct subscription cancellation. If your subscription was purchased directly through SmartTV Club or another authorized payment provider, you must cancel it through the same account, billing portal, payment provider, or cancellation method made available for that purchase.
15.3. Direct refund requests. Refund requests for direct purchases should be submitted through the relevant billing portal or by contacting us at [email protected], unless the applicable payment provider requires a different process.
15.4. Payment provider rules. Direct purchases may also be subject to the terms, refund rules, processing rules, tax rules, and payment policies of the relevant payment provider. - Smart TV Platform Terms
This section applies if you download, access, purchase, activate, subscribe to, or use the App through a smart TV platform, including LG Content Store, LG Apps, Samsung Apps TV, Samsung Smart TV, or another connected TV platform.
16.1. Smart TV platforms. Your use of the App through a smart TV platform may also be subject to the applicable platform’s terms, policies, certification requirements, billing rules, technical requirements, content policies, account rules, and device requirements.
16.2. Platform billing and account systems. Purchases, subscriptions, license activation, cancellations, refunds, and account management made through a smart TV platform may be handled by that platform or by another authorized payment provider, depending on how the purchase, activation, or subscription was completed.
16.3. No platform responsibility for content sources. Smart TV platform providers are not responsible for user-added playlists, IPTV providers, streams, EPG sources, third-party content sources, or content accessed by users through the App.
16.4. Support. For App functionality and account support, users should contact SmartTV Club at [email protected]. For platform account, device, store, billing, installation, or operating system issues, users may need to contact the relevant smart TV platform provider.
16.5. Platform rules prevail for platform-specific matters. Where a smart TV platform’s rules require a specific purchase, activation, cancellation, refund, technical, or support process, that platform-specific process applies to the extent required by the relevant platform rules and applicable law. - Third-Party Services, SDKs, and Technology Providers
17.1. Third-party services. The App may use third-party services, including payment processors, app stores, smart TV platforms, analytics tools, cloud hosting providers, crash reporting tools, customer support tools, and other SDKs or service providers.
17.2. Third-party terms. Such third-party services may be governed by their own terms, policies, and privacy notices.
17.3. No control over third-party services. To the maximum extent permitted by law, we are not responsible for outages, errors, interruptions, policy changes, billing actions, certification decisions, store decisions, installation issues, operating system changes, or technical issues caused by third-party services, platforms, SDKs, devices, operating systems, or providers.
17.4. Platform support. Apple, Google, LG, Samsung, and other platform providers are not responsible for App support except as required by their own terms or applicable law. Support inquiries regarding App functionality should be directed to us. - Privacy and Data Protection
18.1. Privacy Policy. Personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including GDPR, UK GDPR, and other applicable privacy laws where relevant.
18.2. Types of data. Depending on your use of the App, we may process information such as:- email address;
- account information;
- subscription, purchase, or license status;
- device identifiers;
- IP address;
- app version and device type;
- smart TV model or platform information;
- diagnostic logs;
- support communications;
- payment-related identifiers;
- fraud prevention and security signals.
18.3. Playlist and technical source data. Depending on the technical functionality used, the App may process playlist URLs, EPG URLs, playlist files, or related technical data added by you. SmartTV Club does not use such data to provide content and does not claim ownership of user-added content sources.
18.4. User rights. Where applicable, you may have rights of access, rectification, erasure, restriction, portability, and objection.
18.5. Account and data deletion. You may request deletion of your account and personal data through the App settings, where available, or by contacting [email protected]. Certain data may be retained where required or permitted by law, including for fraud prevention, payment records, security, dispute resolution, legal compliance, or legitimate business purposes.
18.6. Complaints. You may lodge a complaint with your national data protection authority if you believe your rights have been violated. - Intellectual Property
19.1. Company ownership. The App, software, code, design, user interfaces, databases, systems, trademarks, logos, trade names, documentation, and related materials are owned by the Company or its licensors and are protected by law.
19.2. No transfer of ownership. These Terms do not transfer ownership of the App or Company intellectual property to you.
19.3. Restrictions. Without our prior written consent, you may not copy, modify, resell, sublicense, rent, distribute, reverse engineer, decompile, extract, scrape, or use App elements for competing services or misleading association with our brand.
19.4. Feedback. Any feedback, suggestions, ideas, or recommendations you submit are non-confidential, and we may use them without restriction or compensation to you. - Anti-Fraud, Abuse Prevention, and Geo Restrictions
20.1. Anti-fraud tools. We may use technical, payment, device, account, risk, or fraud-prevention tools to detect, prevent, and respond to abuse, fraud, payment misuse, spam, security incidents, and violations of these Terms.
20.2. Usage limits. We may apply limits on license usage, device activation, request frequency, account activity, or feature access.
20.3. Restricted jurisdictions. We may deny, restrict, or suspend service to users, accounts, devices, payment methods, or jurisdictions where required or appropriate for legal, sanctions, fraud prevention, regulatory, platform, or security reasons. - Suspension and Termination
21.1. Suspension by Company. We may restrict, suspend, or terminate your access to the App if we reasonably believe that:- you breached these Terms;
- your use violates applicable law or platform policies;
- your use involves prohibited, illegal, sanctioned, or infringing content sources;
- your account is involved in fraud, abuse, spam, payment misconduct, or unauthorized access;
- your use creates legal, security, operational, reputational, or user safety risks;
- we are required to do so by law, platform rules, court order, regulator, payment provider, or competent authority.
21.2. Termination by user. You may stop using the App at any time and may cancel your subscription through the same platform, payment method, or account system through which the subscription was purchased or activated.
21.3. Effect of termination. Upon termination, your right to use the App ends. Access to paid features, subscriptions, licenses, or account data may be disabled, subject to applicable law and platform rules.
21.4. Data after termination. Data may be deleted, anonymized, or retained as described in our Privacy Policy and as required or permitted by law. - Beta and Experimental Features
22.1. Beta features. We may offer beta, test, early access, experimental, or preview features.
22.2. No guarantee. Beta features are provided “as is,” may be incomplete, unstable, unavailable, inaccurate, or removed at any time.
22.3. Data loss. Data associated with beta or experimental features may be deleted or become unavailable without recovery. - Device Compatibility, Playback Quality, and Updates
23.1. Compatible devices. To use the App, you need a compatible device, internet connection, and, where applicable, an active subscription or license.
23.2. Device differences. Functionality, design, performance, supported features, playback quality, settings, and compatibility may vary depending on the device, operating system, app version, region, platform rules, smart TV model, firmware version, and technical limitations.
23.3. Updates. SmartTV Club may update the App from time to time, including by adding, modifying, testing, or removing features, interfaces, compatibility options, or technical functions.
23.4. Automatic updates. You acknowledge that the App may automatically receive updated versions of SmartTV Club software and related third-party components.
23.5. No guarantee of permanent compatibility. We do not guarantee that the App will remain compatible with every device, operating system, firmware version, television model, app store environment, smart TV platform, or third-party platform indefinitely.
23.6. Internet connection. You are responsible for obtaining and maintaining your internet connection and for all fees charged by your internet service provider.
23.7. Playback quality. The quality of playback of user-provided or third-party content accessed through the SmartTV Club player may vary based on factors outside our control, including:- your internet connection;
- device performance;
- Wi-Fi quality;
- stream quality;
- playlist provider stability;
- server availability of third-party content sources;
- geographic routing;
- bandwidth limitations;
- content encoding;
- EPG source quality;
- smart TV platform limitations;
- firmware or operating system changes.
23.8. Recommended speeds. As a general guideline, a download speed of at least 3.0 Mbps may be required for SD playback, at least 5.0 Mbps for HD playback, and at least 15.0 Mbps for Ultra HD / 4K playback. These are recommendations only and do not guarantee playback quality. - Disclaimer of Warranties
24.1. As-is basis. To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis.
24.2. No uninterrupted service. We do not guarantee that the App will be uninterrupted, error-free, secure, accurate, compatible with all devices, available in all locations, or free from defects.
24.3. No content warranty. SmartTV Club makes no warranty and accepts no responsibility regarding any user-added or third-party content source, including its legality, availability, stability, quality, completeness, accuracy, safety, continuity, or suitability.
24.4. No IPTV provider warranty. SmartTV Club does not guarantee and is not responsible for the performance, legality, pricing, support, or conduct of any IPTV provider, playlist seller, broadcaster, content owner, or streaming source.
24.5. Mandatory rights. Nothing in these Terms excludes or limits any rights that cannot be excluded or limited under applicable law. - Limitation of Liability
25.1. Exclusion of indirect losses. To the maximum extent permitted by law, the Company and its affiliates, employees, contractors, licensors, and partners shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential losses, including loss of profits, income, data, business, goodwill, or anticipated savings.
25.2. No liability for content sources. SmartTV Club shall not be liable for any loss, damage, claim, dispute, or issue arising from or related to:- third-party playlists;
- IPTV providers;
- unavailable or unstable channels;
- illegal or unauthorized content sources;
- EPG errors;
- third-party stream quality;
- blocked or removed content;
- sanctions or regulatory restrictions;
- user-added URLs or files;
- disputes between users and content providers;
- platform or smart TV operating system limitations.
25.3. Liability cap. To the maximum extent permitted by law, the Company’s total liability for all claims arising out of or relating to the App shall not exceed the greater of:- EUR 100; or
- the amount paid by you to the Company for the App during the three months preceding the event giving rise to the claim.
25.4. Exceptions. These limitations do not apply where prohibited by law, including liability for intentional misconduct or harm to life or health where such limitation is not permitted.
25.5. Consumer protection. Nothing in these Terms limits mandatory consumer rights that cannot be limited by contract. - Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Company, its affiliates, employees, contractors, licensors, and partners from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:- your use or misuse of the App;
- your account, subscription, or license;
- your user-added playlists, URLs, EPG sources, files, streams, or content sources;
- your violation of these Terms;
- your violation of applicable law;
- your infringement of third-party rights;
- your access to unauthorized, prohibited, sanctioned, or illegal content.
- Copyright and Intellectual Property Complaints
27.1. Copyright respect. We respect intellectual property rights and expect users to do the same.
27.2. No hosted content. Because SmartTV Club does not provide, host, broadcast, retransmit, or distribute content, copyright complaints relating to specific channels, streams, playlists, or content sources may need to be directed to the relevant IPTV provider, broadcaster, hosting provider, playlist provider, or content source.
27.3. Notices to SmartTV Club. If you believe that use of the App involves infringement connected to SmartTV Club’s own software, branding, website, systems, or functionality, you may contact us at [email protected].
27.4. Required information. A copyright notice should include:- identification of the protected work or right;
- identification of the allegedly infringing material;
- your contact details;
- a good-faith statement that the use is not authorized;
- a statement that the information is accurate;
- your physical or electronic signature.
27.5. Repeat infringers. We may restrict or terminate accounts of repeat infringers where appropriate and legally required. - Export Control and Sanctions
28.1. Compliance. You must comply with all applicable export control, sanctions, and restricted-party laws and regulations.
28.2. User confirmation. You confirm that you are not located in, ordinarily resident in, organized under the laws of, or acting on behalf of any country, territory, person, or entity subject to applicable sanctions or restrictions that prohibit your use of the App.
28.3. Prohibited use. You must not use the App in violation of EU, Latvian, U.S., UK, UN, or other applicable sanctions, export controls, media restrictions, or prohibited-use rules. - Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, war, civil unrest, strikes, pandemics, government actions, sanctions, regulatory restrictions, power failures, network failures, platform restrictions, app store actions, smart TV platform actions, payment provider failures, cyberattacks, or third-party service disruptions. - Notices
30.1. Notices to you. Legal notices may be delivered by email, in-app message, website notice, push notification, platform notice, smart TV platform notice, or other electronic means.
30.2. Notices to Company. Notices to the Company must be sent to:

30.3. Electronic communications. You agree to receive communications electronically, including account notices, billing notices, subscription notices, security notices, and updates to these Terms. - Governing Law and Dispute Resolution
31.1. Governing law. These Terms are governed by the laws of the Republic of Latvia, without regard to conflict-of-law rules.
31.2. Consumer rights. Nothing in these Terms limits any mandatory consumer protection rights that you may have under the laws of your country of residence.
31.3. Informal resolution. Before bringing a formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally.
31.4. Courts. Unless mandatory consumer law provides otherwise, disputes arising out of or relating to these Terms or the App shall be subject to the competent courts of the Republic of Latvia.
31.5. Platform rights unaffected. Nothing in this section limits any rights, procedures, or remedies available to you under Apple App Store, Google Play, LG, Samsung, or other applicable platform rules. - Assignment
32.1. Assignment by Company. The Company may assign or transfer its rights and obligations under these Terms to an affiliate, successor, acquirer, or other third party in connection with a merger, acquisition, restructuring, sale of assets, corporate reorganization, or similar transaction.
32.2. Assignment by user. You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. - Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect. The invalid or unenforceable provision shall be replaced, to the extent permitted by law, with a valid provision that most closely reflects the original intent. - No Waiver
Failure by the Company to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right. - Entire Agreement
These Terms, together with the Privacy Policy, any applicable platform terms, subscription terms, purchase terms, payment provider terms, smart TV platform terms, and other policies referenced herein, constitute the entire agreement between you and the Company regarding the App and supersede any prior understandings or communications relating to the App. - Survival
Sections that by their nature should survive termination shall continue to apply after termination of your account, subscription, license, activation, or use of the App, including sections relating to user-added content sources, intellectual property, payments due, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution. - Contact
